Activist Mwabili freed over alleged false online posts,ordered to cooperate with DCI
A Nairobi court has today released activist Mwagogi Hanningtone Danson Mwabili on a personal bond of Sh500,000 over allegations that he published false and misleading information online.
The court has authorized investigators to carry out forensic analysis of his mobile phone and any other electronic devices that may be seized during the investigation.
The orders were issued at the Milimani Law Courts, directing Mwabili to report daily for seven consecutive days to the Directorate of Criminal Investigations.

Investigators had told the court that a Samsung A26 smartphone was seized from Mwabili during his arrest,which is believed to contain material relevant to the case.
The court authorized the DCI Digital Forensic Laboratory to analyse, extract, and, where necessary, print evidential material from the phone.
Mwabili was also ordered to provide all passwords, login credentials, unlock codes, and any other access information to Nickson Kinyua, an investigator attached to the DCI, to enable forensic analysis.
According to court documents, intelligence reports show that between January 2 and January 8, 2025, Mwabili allegedly used an X (formerly Twitter) account to post content described as false, malicious, misleading, and derogatory toward State leadership.
Investigators presented several URLs linking to the posts, which reportedly went viral online.

The viral nature of the content prompted urgent action to prevent recurrence of the alleged offences.
Mwabili was then arrested on February 15, 2026, at the Lunga Lunga Border Point in Kwale County and was later transferred through Mombasa to Nairobi for further processing and arraignment.
Authorities told the court that his prior movements suggested an attempt to evade arrest, making him a potential flight risk.
The forensic orders were also issued to enable the DCI to complete investigations and prepare a file for submission to the ODPP, which will decide whether criminal charges should be preferred.
The matter is scheduled for mention on March 3, 2026, to confirm progress of the investigations.
