Businessman seeks adjournment in Sh106 million fraud case
Proceedings in a fraud case involving businessman Jonathan Ngenga Ndisya were on Friday adjourned after he asked the court to defer the scheduled hearing, citing the absence of his legal counsel.
The matter, before Chief Magistrate Lucas Onyina at the Milimani Law Courts, involves Ngenga and co-accused Peter Kamau, who face multiple charges linked to an alleged conspiracy to defraud.
Ngenga told the court that his advocate, Joe Mwangi, was unable to attend after travelling upcountry to address an emergency, and requested that the hearing be pushed to a later date.
“Your Honour, my advocate has not been able to attend today’s court session after receiving an emergency that required him to travel home. I pray that the hearing be postponed,” he submitted.
The magistrate allowed the request, directing that the case be mentioned virtually on March 2, 2026.
According to the charge sheet, the two accused persons are said to have conspired to defraud Agro Irrigation and Pump Services Limited of Sh106,822,690 between July 2018 and March 2020.
The prosecution alleges that the director of Joncil Enterprises falsely represented that the company had deposited funds into the supplier’s bank account as payment for goods.

In a separate count, the co-accused is alleged to have unlawfully transferred Sh4,777,094 to his personal account while working as an accountant, funds investigators say came into his possession through that role.
He also faces another charge of allegedly diverting Sh3,500,000 belonging to Desire Flora (K) Limited during his tenure there through fraudulent transfers.
Additionally, prosecutors claim he falsified financial records to indicate that Joncil Enterprises had settled the Sh106 million payment to Agro Irrigation and Pump Services, an entry investigators describe as fraudulent false accounting.
The case will be mentioned next month as the court sets timelines for further proceedings.
