Justice Muigai had previously denied Baraza bail, citing concerns for the safety of witnesses and the victim’s family.
Reports from the Directorate of Public Prosecutions (DPP) and the Independent Policing Oversight Authority (IPOA) indicated that some witnesses feared interference or harm if the accused were released.
High Court Judge Kanyi Kimondo on February 17, 2026, directed that the murder case against Baraza be committed to Lady Justice Muigai for trial.
Judge Kimondo went ahead and scheduled pre-trial proceedings for March 9, 2026, either virtually or as directed by the trial court.
“The bail and bond application is denied to protect the victim, family members, and crucial, vulnerable witnesses. This will also prevent possible interference with witnesses.”ruled Justice Muigai on February 9,2025.
In an affidavit, Baraza also expressed concerns about the impact of his detention on his family.
Baraza further stated that his wife has struggled to provide for their children, managing rent, food, and other needs on her own.
He added that the stress has led her to threaten to leave, putting the stability of the family and the well-being of their children at risk.
